    2. VILLA VALETIS

    1. The description of the Villa and the list of equipment are presented in text and photographs on the Villa's website. The owner of the Villa is responsible for the accuracy of the data on the Villa's website.

    2. The Villa must be clean and in full working order when the guest arrives. The owner of the Villa is responsible for the proper functioning of the devices in the Villa. In case of device malfunction, the villa guest must inform the owner of the Villa immediately upon discovery, who is obliged to rectify the problem as soon as possible.

      3. GENERAL RENTAL TERMS

      1. Guests agree to behave responsibly with due care at the Villa and on the Villa's premises, adhering to the rules set out in these Rental Terms and the House Rules posted on the Villa's website and in a visible location in the Villa. The price list for services is also displayed in a visible location in the Villa.

      2. The Villa guest agrees to return the Villa in the condition in which it was received. During the rental period, the Villa guest agrees to immediately report any damage to the Villa or the Villa's premises. Upon departure, the Villa guest agrees to inspect the Villa and the Villa's premises with the owner of the Villa. The Villa guest is responsible for any damage caused to the owner of the Villa. Damage may also include the need for additional cleaning due to the particularly poor condition in which the guest returned the Villa to the owner. In such cases, the Villa owner has the right to deduct this damage from the damage deposit.

      3. If the guest notices inadequate cleaning, damage, or other defects in the Villa upon taking possession, or has other complaints, they are obligated to report them. Complaints regarding cleaning should be made immediately on the spot. Other complaints must be reported to the Villa owner without delay or no later than within 24 hours. In this case, the Villa guest agrees to give the Villa owner a reasonable time to address the complaints.

      4. At no time should there be more people in the Villa than specified, clearly stated on the Villa's website. During their stay at the Villa, the Villa guest agrees to inform the Villa owner in advance of all visitors coming to visit them. The Villa guest is required to seek permission from the Villa owner if the total number of people in the Villa or on the Villa's premises exceeds the specified limit.

      5. The Villa owner cannot be held responsible for noise coming from neighboring properties, construction sites, roads, etc. If the Villa owner can influence the reduction of such noise, they will do so as soon as possible. While on the Villa's premises, guests must not disturb public order and peace.

      6. The Villa owner is responsible for the functionality of the pool equipment, pool cleaning, and the condition of the water in the pool.The owner of the Villa controls the quality of the water and the correctness of both pools three times a week, and determines the time of arrival in agreement with the guest. Villa guests are obliged to follow the instructions given by the Villa owner regarding the use of the pool. A sign with basic instructions for using the pool is displayed in a visible location near the pool. The use of the pool is at the guests' own risk. Children must not be in or near the pool without adult supervision. Without permission, Villa guests must not touch or damage the external pool equipment, nor stand on the pool covers. In case of damage to the external pool equipment or pool cover, the Villa guest agrees to compensate the owner of the Villa directly for the damage. There is a possibility that the pool may not be in use during the offseason.

      7. Guests are allowed to keep pets in the villa upon prior inquiry, as stated on the villa's website. Villa guests are responsible for cleaning up after their pets. Pets are not allowed to use the villa's furniture, and any evidence of furniture use by pets may incur additional costs to villa guests. Pets must be vaccinated against rabies and all other diseases according to applicable regulations. The villa owner assumes no responsibility for any illness or injury that pets may suffer during their stay in the villa or on the villa's property, nor for allergic reactions of villa guests that may occur due to pet ownership. Pets are strictly prohibited from accessing the pools.

      8. Smoking is not allowed in the villa. Smoking outside the villa is permitted. Smokers are requested not to throw cigarette butts in the villa's yard.

      9. The departure of a guest from the villa before the expiration of the agreed rental period and without prior notice and agreement with the villa owner will be at the risk and expense of the villa guest.

      10. Accommodation prices listed on the villa's website are in euros. 

      Within ten (10) days from the date of the query, the guest has a deadline for payment of an advance in the amount of 30% of the total contracted price of accommodation for the reserved period to the owner of the Villa via bank transfer.

      The rest of 70% of the total contracted accommodation price is paid by the Villa guest to the Villa owner's account no later than thirty (30) days from the start of the rental period if payment is made via bank transfer or cash on the day of arrival. If the reservation is made less than 30 days from the beginning of the rental period, the guest of the Villa pays the full amount of accommodation to the account of the owner of the Villa.
      The owner of the Villa cannot be responsible for the fees of other banking institutions.

      In case of cancellation of the reservation up to 60 days before arrival, the advance payment is returned in full. In case of cancellation between 59 and 45 days before arrival, the advance payment is refunded in the amount of 50% of the amount of the payment made. In case of cancellation between 44 and 30 days before arrival, 25% of the advance payment is refunded to the guest. For cancellation less than 30 days before the rental, the advance payment is not returned to the guest.

       Guests are advised to arrange their own cancellation insurance policy.

      11. Upon handover, the villa owner issues a rental invoice to the villa guest. Water, electricity, and internet costs, as well as bed linen, towels, kitchen towels, final cleaning of the interior of the villa, sauna, pool and garden maintenance, registration of stay, and tourist tax are included in the accommodation rental price.

      12. The villa owner cannot be held responsible in case of "force majeure" (war, natural disaster, ecological disaster, epidemics, border closures, strikes...) that could not have been foreseen at the time of the rental agreement.

      13. In accordance with the provisions of Regulation (EU) No 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, all villa guests provide the villa owner with a valid personal document (identity card, passport) or Consent for the use of necessary personal data for the purpose of guest registration. The villa owner may not use the personal data of villa guests for other purposes. After registering villa guests, the villa owner is obliged to destroy the collected personal data of guests.

      14. Villa guests have the right to lodge a written complaint about the accommodation service provided. The written complaint is to be sent to the email address of the villa owner: villa.valetis@gmail.com. The villa owner is required to respond to the complaint in writing within 15 days of receiving the complaint.

      4. RENTAL PROCEDURE AND HANDOVER OF THE VILLA

      1. The rental procedure for the villa begins with the reservation of the villa. 

      Within ten (10) days from the date of the inquiry, the guest has a deadline for payment of an advance in the amount of 30% of the total contracted accommodation price for the reserved period to the owner of the Villa via bank transfer. The rental agreement is considered concluded at the moment the owner of the Villa receives the advance payment. In the event that the payment is not made within ten (ten) days from the date of reservation, the Rental Agreement is considered terminated, and the owner is authorized, without special notification to the guest of the Villa, to enter into a new Rental Agreement with another guest. The owner of the Villa, although he is not under any obligation, may send a notification to the guest of the Villa before the termination of the Rental Agreement as a reminder of the obligation to pay with an appropriate period of execution.

      The Villa guest pays the balance of 70% of the total contracted accommodation price to the Villa owner's account no later than thirty (30) days from the start of the rental period if payment is made via bank transfer or cash on the day of arrival. If the reservation is made less than 30 days from the beginning of the rental period, the guest of the Villa pays the full amount of accommodation to the account of the owner of the Villa.       2. By paying the deposit for the reservation, the villa guest unconditionally accepts these Rental Terms. After receiving the deposit payment, the villa owner sends the guest a written Reservation Confirmation via email. The Reservation Confirmation includes: the contact details of the villa owner, the address and location of the villa, the number of villa guests, the number of guests under 25 years old, the number of children up to 1 year old, the number of pets, the period of villa reservation, the arrival and departure times of the villa guests, the amount of the paid deposit, and the total rental amount for the reservation period. The written reservation confirmation, together with these Rental Terms, constitutes the Villa Rental Agreement.

      3. During the reservation process, the guest must declare the number of pets. The cost of regular cleaning, amounting to 10 Euros per pet per day, is added to the total rental price of the villa. It is not allowed to have a greater number of pets than the one declared and listed on the Reservation Confirmation.

      4. On the day of reservation, the villa guest must be at least 25 years old. If the majority of guests are younger than 25 years old, it is mandatory to inform the villa owner immediately during the reservation about the exact number of villa guests and their ages. In such cases, the villa owner may request the guest to pay an additional deposit to secure against property damage in order to retain the reservation. The villa owner reserves the right to refuse groups of guests younger than 25 years old if not informed of their arrival. In this case, the villa guests do not have the right to a refund of the rental amount paid.

      5. The maximum number of people allowed to be accommodated in the Villa or on the Villa property at any one time is five (5). This number does not include children under one year of age. At any time, there must not be more people in the Villa or on the Villa property than indicated in the Reservation Confirmation. A request to change the number of people staying in the Villa must be sent in writing via email to the villa owner no later than three (3) days before the guest's arrival.

      6. The scheduled time for guests to arrive at the Villa is earliest at 3:00 PM local time. The scheduled time for guests to depart from the Villa is latest at 10:00 AM local time. If a guest arrives at the reserved accommodation after 8:00 PM, they are required to notify the late arrival in advance. Earlier check-in and later check-out up to 3 hours before the official time are not charged. For check-in earlier and check-out later than 3 to 10 hours after the official time, a surcharge of 50% of the nightly rate applies. For check-in earlier and check-out later than 10 hours after the official time, the full nightly rate is charged. Earlier check-in and later check-out are possible only on days when there are no other guest departures/arrivals and are arranged individually with the villa owner.

      7. The villa owner welcomes guests for the handover of the villa and the guest registration process. During the handover of the villa, the guest is obliged to present a valid identification document to the villa owner for the guest registration process. The handover of the villa will only take place if the full rental amount has been paid and a deposit of €500.00 has been provided. The deposit serves as insurance against damage to the owner's property. The villa owner refunds the full deposit amount to the guest upon departure if there has been no damage to the owner's property during their stay. In the event that the guest causes damage to the property, the villa owner may deduct the incurred damage from the deposit. If the damage exceeds the amount of the deposit, the villa owner has the right to request the remaining amount in cash from the guest on the spot. In the event of a later departure than agreed, the guest undertakes to pay all additional costs in cash on the spot.

      5. CANCELLATION OF THE RENTAL AGREEMENT

      1. The villa guest may cancel the Villa Rental Agreement with the villa owner only by written email, without the obligation to state a specific reason for the cancellation. The cancellation of the villa rental agreement shall apply from the day the villa owner confirms receipt of such cancellation.

      In case of cancellation of the reservation up to 60 days before arrival, the advance payment is returned in full. In case of cancellation between 59 and 45 days before arrival, the advance payment is refunded in the amount of 50% of the amount of the payment made. In case of cancellation between 44 and 30 days before arrival, 25% of the advance payment is refunded to the guest. For cancellation less than 30 days before the rental, the advance payment is not returned to the guest.

      In all other cases of cancellation and non-arrival, the deposit will not be refunded. Villa guests are advised to personally arrange cancellation insurance. If the villa guest finds another guest as a replacement for the same period and under the same conditions, the villa owner will transfer the Villa Rental Agreement upon written receipt of the necessary data about the new villa guest. In this case, the villa owner will send a written Reservation Confirmation to the new villa guest. The villa owner will retain the rental amount already paid by the first guest. The new guest is obliged to pay the remaining rental amount to the full amount, if it exists.

      2. The villa owner may cancel the Villa Rental Agreement with the villa guest in case:
      • villa guests do not adhere to the rules of the House Rules and these Rental Terms,
      • the villa guest does not make payments within the deadlines specified in these Rental Terms,
      • villa guests cause damage to the villa property or the villa's estate due to negligent behavior,
      • villa guests do not follow the instructions of the villa owner and do not comply with the provisions of these Rental Terms related to the use of the pool and pool equipment,
      • all villa guests do not provide the villa owner with a valid personal document (identity card, passport) during the handover for the prescribed guest registration process,
      • without the owner's specific approval, more guests stay in the villa or on the villa's estate than prescribed,
      • villa guests have not informed the villa owner in advance by written email that they are a group of guests under 25 years of age,
      • the majority of villa guests are under 25 years of age and do not want to pay an additional deposit to cover damages to the villa owner's property,
      • the villa guest brings pets without prior notice and approval from the villa owner and without proof of vaccination of pets against rabies and other diseases in accordance with applicable regulations,
      • villa guests disrupt public order and peace or disregard warnings from the villa owner to cease disturbing public order and peace,
      • guests smoke inside the villa,
      • "force majeure" events described in these Rental Terms occur.

      6. FINAL PROVISIONS

      1. Special requests not included in the villa rental price (such as ordering groceries, food and beverages, chefs, etc.) should be communicated in advance by the villa guest in writing via email to the villa owner. If possible, the villa owner will fulfill the villa guest's special requests personally or through a third party.

      2. In case of breach of the provisions of these Rental Terms, the villa owner is authorized to terminate the Rental Agreement, whereby the villa guest has no right to request a refund of the paid accommodation amount from the villa owner. Termination of the Villa Rental Agreement takes effect immediately, without notice period. Villa guests are obliged to immediately vacate the Villa permanently.

      3. Unauthorized use of data published on the villa's website, even partially, is prohibited by law and constitutes a violation of copyright.

      4. The House Rules and these Rental Terms are published on the villa's website in Croatian, English, German, and Italian. In case of doubt regarding interpretation, the Croatian version shall prevail.

      5. In the event of a contractual dispute, the contracting parties will seek to resolve all disputes amicably. Otherwise, the jurisdiction of the court in Rovinj and the application of Croatian law are agreed upon.
